Background
New Jersey established a law that allowed money to be sent to parents to give to their children to use for public transportation. Children who attended catholic schools also qualified for these subsidies. This qualifictation enraged a fellow tax payer named Everson. He sued stating that this violates the first amendment in the New Jersey Constitution, seperation of Church and state.
